Decree 82, effective from July 10, 2024, has solved potential problems of waste and loss of state budget that may occur in investment in information technology applications.
Specifically, Decree 82 for the first time strongly institutionalizes the investment and procurement of popular software that many ministries, central and local agencies have the need to invest, purchase, and hire information technology services that are similar in terms of basic functions and technical features nationwide or within the scope of industries, specialties, and fields. The Decree removes the provisions on funding limits for design cases, strongly decentralizes to competent authorities to decide on investment and design plans for investment projects. The legal content has officially specified the method and way to determine the value of software built, developed, upgraded, and expanded based on software, digital platforms, etc., which is the basis for resolving recommendations and problems over the years of many agencies and organizations in information technology investment activities. The Decree also adds mandatory requirements for maintaining, operating, and maintaining products of information technology investment projects; especially removing bottlenecks with mandatory regulations to ensure funding for this activity.
According to the new Decree, in the investment, procurement and leasing of information technology services, there will be no additional administrative procedures between state agencies, but 2 more internal administrative procedures will be cut and 2 more internal administrative procedures will be simplified.
Decree 82 is considered very timely, demonstrating the political determination and the attention, close and drastic direction of the Government in removing obstacles and bottlenecks in institutions and policies for digital transformation implementation.
