According to the provisions of the Law on Prevention of Tobacco Harms, heated (heated) tobacco is understood as tobacco and falls within the scope of regulation of the law. However, e-cigarettes are not yet within the scope of the law. The Government is assigning relevant ministries and branches to draft a Decree amending Decree 67 on tobacco business, but it has not been completed yet to submit to the Government for promulgation.
According to the Ministry of Health, after many years of tobacco harm control, the percentage of smokers in Vietnam has decreased from over 53% of adult men to over 45%, and from 2% down to 1.1% of women. However, it is worrisome that the rate of e-cigarette use has increased, especially among young people. A study conducted by the Institute of Health Strategy and Policy in 2020 showed that the rate of e-cigarette use among students in grades 8-12 is 8.35%, the age of students in grades 10-12 is higher with 12.6%.
The law must be consistent with reality and from practice to complete the law. Therefore, it is necessary to immediately have legal regulations on business and use of new kinds of cigarettes, as a basis for strict management of this product.
